1. Information on how to enter forms part of the terms and conditions of entry. Entry into the promotion is deemed acceptance of these terms and conditions. Headings in this document are included for ease of reference, and do not affect interpretation in any way.
2. The promoter is Qantas Airways Limited (ABN 16 009 661 901) of 10 Bourke Road, Mascot, NSW 2020 (telephone number 02 9691 9397) (Promoter).
Duration
3. All references to time in this document are a reference to the local time in Sydney, New South Wales, Australia on the date stated. The promotion commences at 12:01am, 9 September 2024 and closes at 11:59pm on 31 October 2024 (Promotion Period).
Eligibility to enter
4. Entry is open only to Qantas Business Rewards members with an activated account (Eligible Entrants), excluding directors, management, employees and their immediate families of Mike Da Silva and Associates (AUST) Pty Ltd ABN 50 003 894 022 (MDSA) and each of their related bodies corporate
5. Eligible Entrants must not:
a) have a corporate or any other private airfares agreement, discount or rebate provided by Qantas (outside of the discounts available as a level 1, 2 or 3 Qantas Business Rewards member) including through a third party arrangement and/or
b) be a travel agent, travel wholesalers or travel consolidator and/or
c) be any other sellers or re-seller of air travel.
Entry into the promotion
6. To enter, Eligible Entrants who are 18 years of age or older must during the Promotion Period:
a) If they are an existing Qantas Business Rewards Member:
i) Register their entry for the promotion via https://www.qantas.com/au/en/business-rewards/exclusive-offers/QBES363.html;
ii) Make an eligible flight, Qantas Hotels or Avis car hire booking or spend at least $1 with any Qantas Business Rewards program partner listed here by 11:59pm (AEDT) 30 November 2024; and
iii) Receive Qantas Points from the booking (Eligible Booking) or transaction into their Qantas Business Rewards account by 11:59pm (AEDT) 28 February 2025.
b) If they are not an exisiting Qantas Business Rewards Member:
i) Join Qantas Business Rewards during the Promotion Period;
ii) Make an eligible flight, Qantas Hotels or Avis car hire booking or spend at least $1 with any Qantas Business Rewards program partner listed here by 11:59pm (AEDT) 30 November 2024; and
iii) Receive Qantas Points from the booking (Eligible Booking) or transaction into their Qantas Business Rewards account by 11:59pm (AEDT) 28 February 2025.
7. Each Eligible Entrant who completes the steps in clause 6 will be automatically entered into the promotion. Eligible entrants will receive one (1) entry per Qantas Business Rewards partner listed here and/or one (1) entry for each eligible Qantas flight booking, Qantas Hotels booking and/or Avis car hire booking made within the Promotion Period.
8. An Eligible Booking for the purpose of this promotions includes:
a) A flight booking: a domestic or international flight operated by Qantas, Emirates or American Airlines which has a Qantas 'QF' flight number on the ticket, where Qantas Points are normally earned by Qantas Business Rewards members, that is purchased in Australia; and has a ticket number commencing with '081'. An eligible Jetstar flight for the purpose of this promotion means a flight operated by Jetstar, with a JQ flight number designator that includes a Jetstar Eligible Bundle and is booked via your Business Account or jetstar.com and travelled for business where Qantas Points are normally earned. Qantas Points earned on air travel are determined in accordance with the Airline Earn Table. For full details, see the Qantas Business Rewards Airline Reward Scheme Terms and Conditions. The Qantas Business Rewards member's ABN and the traveller's Qantas Frequent Flyer membership number must be quoted at the time of booking.
b) A Qantas Hotels booking: hotel stays booked through qantas.com/hotels or their Qantas Business Rewards Account, except Classic Hotel Rewards and Airbnb bookings. The Qantas Business Rewards member's ABN and the traveller's Qantas Frequent Flyer membership number must be quoted at the time of booking. Qantas Points can be earned on cash only purchases and the cash component of Points Plus Pay purchases on eligible bookings and will not be earned on cancelled or refunded bookings. A minimum spend of AUD $100 applies per booking. Qantas Points may be earned by the member in whose name the booking is made. Qantas Points will be credited to your account at least 8 weeks after check-out.
c) A car hire booking: freely available retail rates booked through your Business Rewards Account, qantas.com, a travel agent or Avis at avis.com.au or by calling 136 333. Qantas Points are not accrued on fees nor charges including but not limited to excess kilometers, one-way fees, airport fees, late return fees, collection or recovery costs, roadside callout fees or any other ancillary product. Package holiday rentals, government rates, industry discounted rates, group rates, some corporate rates, other special promotional rates and miscellaneous charges are not eligible to receive Qantas Points. Qantas Points cannot be earned on Classic Car Rewards. The number of Qantas Points earned is limited to 240,000 per year. To earn Qantas Points for business when booking via qantas.com the member must include their ABN associated with their Qantas Business Rewards Account when booking. To earn Qantas Points for business when booking through a travel agent or Avis, the member must join Avis For Business (including their ABN), and include or quote their Avis For Business Wizard number when booking. Points are awarded for vehicle rentals purchased at rates determined by Avis. Unless otherwise specified by the car rental company, Qantas Points will not be earned for car rentals of the type described: vehicle rentals purchased as part of package holidays; free vehicle rentals; vehicle rentals at industry discount rates; vehicle rentals using Award vouchers or discount certificates; or contracted corporate or government rates.
9. The Promoter is not responsible for any lost, late or misdirected entries.
10. The time of entry will be deemed to be the time the entry is received by the Promoter.
11. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Drawing of entries
12. The draw will take place at 10:00am (AEDT) on Friday 14 March 2025. The draw will be conducted by Mike Da Silva Associates (MDSA), Level 16, 1 Denison Street, North Sydney NSW 2060 (Drawer).
13. The result of the draw is final and no correspondence will be entered into.
The prize
14. There will be one (1) prize which includes one (1) $25,000 AUD Qantas Airways flight credit voucher, one (1) $20,000 AUD Qantas Hotels credit voucher and one (1) $5,000 AUD Avis credit. The maximum total prize pool value is $50,000 AUD. The Promoter accepts no responsibility for any variation in the value of the prizes.
15. The winner will be able to redeem the prize from 11 April 2025 for a period of 12 months (Prize Term). Following the Prize Term, the prize, or any unused value of the prize, will expire and cannot be redeemed. To redeem means to book travel, travel does not need to be completed during the Prize Term. Cancelled or amended bookings after the Prize Term will be subject to the terms and conditions applicable at the time of the booking.
16. The winner must remain a Qantas Business Rewards member during the Prize Term.
17. The $25,000 AUD Qantas Airways flight credit voucher will be credited to the Account Holder of the Qantas Business Rewards membership in the form of a Universal Air Travel Plan (UATP) account/card to be used in accordance with these terms and conditions, including:
a) must only be used for the purposes of booking:
i) Qantas marketed and operated flights via Qantas.com, directly through the Qantas Business Rewards Account or using the winner’s preferred travel agent for the business, the prize cannot be used on Qantas flights operated by another airline or on flights with a QF flight number operated by another airline;
ii) Qantas Additional Baggage Allowance for flights booked in accordance with clause 16(c)(i); and
iii) Qantas Advance Seat Selection for flights booked in accordance with clause 16(c)(i).
b) Flights booked must be for business purposes (i.e. an ABN entered into each booking) for travellers stored within the winner’s Qantas Business Rewards account only.
c) Flights booked with the prize earn Qantas Points and/or Status Credits for the Qantas Frequent Flyer and for the business. A business not registered for GST will not receive Qantas Points for the business
d) Flights booked using the prize are combinable with any current (at the time of booking) Qantas Business Rewards or Qantas Frequent Flyer offer, subject to the specific terms of that offer.
18. The $20,000 AUD Qantas Hotels credit voucher will be issued to the Account Holder of the Qantas Business Rewards membership via email to be used in accordance with these terms and conditions, including:
a) must only be used for the purposes of booking:
i) Hotels directly through Qantas Hotels (qantas.com/hotels) and cannot be used on Classic Hotel Rewards, Airbnb and Qantas Holiday packages booked through (qantas.com/holidays).
b) Hotel stays booked must be for business purposes (i.e. an ABN entered into each booking)
c) Hotel stays booked with the prize will not earn Qantas Points for the business or the individual.
d) Hotel stays booked using the prize are not combinable with any current (at the time of booking) Qantas Business Rewards or Qantas Frequent Flyer offer, subject to the specific terms of that offer.
19. The $5,000 AUD Avis Car Hire credit will be credited to the Account Holder of the Qantas Business Rewards membership in the form of a chargeback account (the Chargeback Credit) to be used in accordance with these terms and conditions:
a) The winning Account Holder is required to appoint a nominated representative responsible for making bookings using the Chargeback Credit. Details of the nominated representative must be provided to Avis by sending an email to: nzsalessupport@abg.com;
b) The Chargeback Credit must only be used for bookings of car rental services:
· in Australia ONLY; and
· for business purposes ONLY. Renters may be required to provide evidence of employment when collecting the vehicle; and
· made by the Account Holder’s nominated representative by contacting Avis Sales Support on 1800 065 308.
c) Avis’ normal Rental Terms and Conditions apply to all bookings using the Chargeback Credit (these terms include the Renter Requirements and Pre-Authorisation Amount provisions);
d) Subject to (e) below, the Chargeback Credit will be applied to Additional Fees and Charges incurred at the end of the rental in accordance with the Avis Rental Terms and Conditions;
e) Chargeback Credits cannot be applied to the payment of tolls, fuel charges, infringement notices and fines, electric charging charges, costs for damaged vehicles or damage excess fees;
f) Car hire booked using the Chargeback Credits will not earn Qantas Points for the business or the individual;
g) Car hire booked using the Chargeback Credits is not combinable with any current (at the time of booking) Qantas Business Rewards or Qantas Frequent Flyer offer, subject to the specific terms of that offer;
h) Bookings using Chargeback Credit is subject to vehicle availability; and
i) The Chargeback Credit is not redeemable for cash and is not transferable.
20. The Promoter, in their sole discretion, may not allocate any Prize(s), or fewer than the number of Prize(s) stated above (including in circumstances where insufficient entries are received). The Promoter accepts no responsibility in the event the prize is stolen, lost or misused. The Winner is responsible for redemption of the prize.
21. The prize includes GST and taxes included in the price of the booking. Unless otherwise stated, the prize does not include travel insurance, passports, visas, meals, taxes not included in the price of the ticket, ground transportation, accommodation or any other costs of a personal nature. Compliance with any health or other government requirements is the responsibility of the prize-winner and beneficiaries of the prize. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination. Prize travel is subject to Qantas’ General Conditions of Carriage where applicable.
22. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. Prizes are not exchangeable or redeemable for cash or other goods or services. A prize cannot be transferred to any other person, unless agreed to by the Promoter. It is a condition of accepting a prize that the winner accepts the conditions of use of that prize.
23. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Notification of the winner
24. The winner will be notified by email by 18 March 2025, and their last name, first initial and postcode will be published on the Promoter’s website from 20 March 2025 for a minimum of 28 days at https://www.qantas.com/au/en/business-rewards/info/sepoct-2024-terms-and-conditions.html.
Right of the Promoter to redraw
25. The Promoter reserves the right to redraw in the event of an entrant being unable to satisfy these promotion terms and conditions or forfeiting or not claiming a prize. For any prize that remains unclaimed at 5:30pm (AEDT) on 14 April 2025, a second draw will be conducted by the Drawer on 16 April 2025 at the same time and place as the original draw, subject to any written direction given under applicable law. Any winners determined in accordance with the clause will be notified by email by 16 April 2025, and their last name, first initial and postcode will be published on the Promoter’s website from 18 April 2025 for a minimum of 28 days.
Limitation of liability and variation of terms
26. If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations. The Promoter reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this promotion.
27. The Promoter, its related bodies corporate and their respective officers, employees, contractors and agents (Promotion Parties) will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this promotion, the promotion of this promotion or the use of any prize, including but not limited to any breach of these terms and conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (Damages) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promotion Parties.
28. The exclusion of liability in clause 27 does not apply to limit or exclude liability:
a) for personal injury or death suffered or sustained in connection with the supply of goods or services which are supplied by the Promoter in the ordinary course of business. To remove doubt: third party goods or services, which other than in connection with this promotion, are in the normal course of business supplied by a third party unrelated to the Promotion Parties, are not supplied by the Promoter in the ordinary course of business and the Promoter’s Conditions of Carriage and general booking conditions (and any exclusions contained therein) apply despite any statement to the contrary in these terms and conditions; or
b) to the extent it is not permissible at law to limit or exclude liability in the manner contemplated in that clause (in which case that liability is limited to the maximum extent allowable by law).
Entry details and privacy
29. Entry details remain the property of the Promoter. The name and photograph of the winner may be used for promotional purposes by the Promoter, unless the winner otherwise notifies the Promoter at the time of accepting the prize. Entrants consent to the Promoter using personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prizes (including to third parties and any applicable statutory authorities). Without limiting the foregoing, entrants’ personal information provided in connection with this promotion will be handled in accordance with the Promoter’s Privacy Statement, visit www.qantas.com/privacy to obtain a copy.
Tax Implications
30. The Promoter accepts no responsibility for any tax implications that may arise from accepting a prize. Independent financial advice should be sought.
Fringe Benefits Tax
31. Receipt of a prize may have Fringe Benefits Tax (FBT) implications. To the extent that there is any FBT liability, this will be paid for by the employer of the recipient. The grossed-up value of a prize and any other Fringe Benefits the recipient receives during the course of the FBT year may be reported on the recipient's annual PAYG Payment Summary as required by taxation law.
