Terms and Conditions of Use

1. When Do These Terms Apply

1.1       You accept these Qantas Agency Connect Site Terms when you or your Staff access the Qantas Agency Connect Site.

1.2       The Qantas Standard Agency Terms and Conditions also apply.

1.3       If there is any inconsistency between the Qantas Agency Connect Site Terms and the Standard Agency Terms, then to the extent of any inconsistency the order of priority is:

     (a)        the Standard Agency Terms; then

     (b)        these Qantas Agency Connect Site Terms.

2. Registration

2.1       To become a Registered User, you must register on the Qantas Agency Connect Site by providing Qantas the information requested. 

2.2       Access to the Qantas Agency Connect Site will only be granted upon acceptance of your registration to the satisfaction of Qantas.

2.3       If Qantas accepts your registration, Qantas will notify you by email of the success of the registration and you will be given log in details and access to all or part of the Qantas Agency Connect Site.

3. Registered User’s Licence to use the Secured Site

3.1       If you become a Registered User, Qantas grants you and your Staff a non-exclusive licence (Licence) to access and use the Qantas Agency Connect Site to:

     (a)        make and change service requests;

     (b)        access to the Qantas Booking Facility to make and service bookings through the Qantas Booking Facility; and

     (c)        use any Documentation to the extent required to make and service those bookings or service requests.

4. Registered User’s obligations

4.1       Registered Users must:

     (a)        ensure that all information supplied to Qantas is complete and accurate and immediately notify Qantas of any changes, including but not limited to registration details, banking details (if applicable for the Qantas Booking Facility) and your user profile;

     (b)        ensure that you and your Staff comply with these Qantas Agency Connect Site Terms; and

     (c)        take all steps necessary to ensure that access to the Qantas Agency Connect Site is restricted to your current Staff who are authorised to access the Qantas Agency Connect Site, including but not limited to maintaining adequate security and confidentiality of passwords.

4.2      Registered Users must not:

     (a)        allow any third parties, including but not limited to your customers, direct access to the Qantas Agency Connect Site.  This includes not providing or otherwise making available the Qantas Agency Connect Site or Documentation in any form to any person except as expressly authorised by these Qantas Agency Connect Site Terms; or

     (b)        create any hyperlink from a website to the Qantas Agency Connect Site unless otherwise authorised in writing by Qantas.

4.3       Registered Users may allow ticket centres to issue tickets for their customer bookings and service those bookings in accordance with the relevant customer’s instructions and applicable laws. It is the Registered Users’ responsibility to ensure that such ticket centres comply with applicable laws and the Qantas Standard Agency terms. 

5. Making and Servicing Bookings

5.1       To make or service a booking in the Qantas Booking Facility, you must provide all mandatory information requested by Qantas as part of the booking process.

5.2       All bookings made through the Qantas Booking Facility will be allocated to the Registered User.  Qantas will not be liable in relation to such bookings.  Tickets for bookings made by you or your Staff using the Qantas Agency Connect Site will be issued by Qantas.

5.3       Prior to making a booking for a customer through the Qantas Booking Facility, you must provide the customer with the relevant terms and conditions in respect of the booking issued by Qantas from time to time, including but not limited to Qantas’ Conditions of Carriage and any other conditions relating to the fare type being purchased.

5.4       Any changes to bookings made on the Qantas Agency Connect Site after a booking has been paid for and finalised on behalf of the customer must be made either through the Qantas Booking Facility or Qantas telephone sales. Fees may apply. Group or charter bookings cannot be transacted online via the Qantas Agency Connect Site.

5.5       Service fees may apply to service requests made through the Qantas Agency Connect Site.

5.6       Failure to comply with these Qantas Agency Connect Terms, Qantas’ policies or directions may result in an Agent Debit Memo being issued or other fees or charges applying.

6. Payment of Bookings

6.1       Payments to Qantas must be made by the customer’s Credit Card or such other payment method supported by the Qantas Agency Connect Site.

6.2       For each booking made through the Qantas Booking Facility:

     (a)        you must obtain a written authority from the customer authorising the use of their Credit Card or other payment method supported by the Qantas Agency Connect Site. If Qantas is required to refund any amount as a result of your failure to obtain such authorisation, the amount becomes a debt immediately payable to Qantas and Qantas may set off this amount against any payment due to you under these Qantas Agency Connect Site Terms, the Qantas Standard Agency Terms or any other arrangement;

     (b)        payment must be made in accordance with applicable terms and conditions, including fare conditions; and

     (c)        you must disclose to the customer any fees associated with a particular payment method used by the customer.

7. Liability

7.1       The Qantas Agency Connect Site, Qantas Booking Facility and Documentation cannot be guaranteed error free and Qantas will have no liability with respect to any errors.

7.2       You indemnify Qantas against any costs (including any fines or penalties), loss or expenses incurred by Qantas as a result of:

     (a)        any breach of these Qantas Agency Connect Site Terms by you or your Staff; and

     (b)        any actual or alleged infringement of any Intellectual Property Rights in the Qantas Agency Connect Site or the Documentation by you or your Staff.

8. Intellectual Property Rights

8.1       The Documentation and other material contained on the Qantas Agency Connect Site is protected by copyright. Except to the extent permitted by relevant copyright legislation, you must not use, copy, modify, transmit, store, publish or distribute the Documentation or other material on the Qantas Agency Connect Site or create any other material using such material without obtaining the prior written consent of Qantas.

8.2       Except as otherwise set out in the Qantas Standard Agency Terms or these Qantas Agency Connect Site Terms:

     (a)        no Intellectual Property Rights in the Qantas Agency Connect Site or Documentation are acquired by, or granted to you and your Staff; and

     (b)        you and your Staff must not engage in or permit any act which infringes the Intellectual Property Rights in the Qantas Agency Connect Site or the Documentation.

9. Confidential Information

9.1       To the extent the information available on the Qantas Agency Connect Site and the Documentation is not publicly available (Confidential Information), it must be kept confidential.

9.2       You or your Staff must:

     (a)        not disclose any Confidential Information to any person unless required by law to do so or with the prior written consent of Qantas; and

     (b)        take reasonable steps to maintain the confidentiality of the Confidential Information.

9.3       You acknowledge that Qantas communications sent by email or via the Qantas Agency Connect Site may contain confidential or personal information and should only be read by those persons to whom the communication is addressed.

10. Termination

10.1       You may terminate your access and use of the Qantas Agency Connect   Site at any time and without notice. 

10.2       Qantas may terminate the Licence and your access to the Qantas Agency Connect Site:

     (a)        at any time upon 30 days’ written notice to you; or

     (b)        immediately:

                (ii)            if you have commit a breached of these Qantas Agency Connect Terms, the Qantas Standard Agency Terms and Conditions or any policies and procedures set out on the Qantas Agency Connect Site, and such breach which is capable of remedy, but is not remedied within 14 days after receiving notice requiring you to do so; or

               (ii)            if you commit a breach of these Qantas Agency Connect Terms, the Qantas Standard Agency Terms and Conditions or any policies and procedures set out on the Qantas Agency Connect Site, and such breach is not capable of remedy; or

              (iii)           any applicable licence, IATA or TIDS membership is cancelled, revoked, expires or lapses.

Without limiting Qantas’ right to terminate your Licence or access to the Qantas Agency Connect Site, Qantas may suspend the Licence and your access to all or part of the Qantas Agency Connect Site immediately if Qantas reasonably believes you are in breach of these Qantas Agency Connect Terms or the Qantas Standard Agency Terms and Conditions.

Upon termination of your Licence, you and your Staff must not access the Qantas Agency Connect Site and must destroy any remaining copies of the Documentation or otherwise return or dispose of the Documentation in the manner directed by Qantas.

11. Cookies and Use of Data

11.1       Cookies are small pieces of data stored on the web browser on your computer. The Qantas Agency Connect Site and associated websites (including those you reach by clicking on advertising) may store cookies on your web browser.

11.2      If you disable the use of cookies on your web browser or remove or reject specific cookies from the Qantas Agency Connect Site or linked sites, then you may not be able to gain access to all content and facilities of the Qantas Agency Connect Site.

11.3      Qantas may use the data provided by You on the Qantas Agency Connect Site for marketing and related purposes and Qantas may contact You for the purpose of undertaking surveys or other communications related to Your use of the Qantas Agency Connect Site or Qantas Agency Connect phone service.  We will provide an option to unsubscribe or opt-out of further communication on any electronic marketing communication sent to you.

12. General

12.1       Qantas may amend these Industry Sales Site Terms with such changes taking effect on 30 days’ notice or earlier if required by law or for operational reasons.

12.2       These Qantas Agency Connect Site Terms are governed by and construed according to the law of the State of New South Wales, Australia and each party submits to the non-exclusive jurisdiction of the courts of that State.

12.3       A party notifying or giving notice under these Qantas Agency Connect Site Terms must give notice in writing and sent to the e-mail or postal address of the other party (as notified by the other party from time to time). Your address for notices will be as stated on the registration form unless otherwise notified. Such a notice is received (a) on the date of delivery if left at the recipient's address, (b) three days after the date of posting if sent by prepaid post or (c) immediately provided there is no error in transmission if sent by e-mail.

13. Definitions

Confidential Information has the meaning given to it in clause 9.

Credit Card means a credit or charge card issued by or carrying the mark of either American Express, Diners Club International, Mastercard, Visa, Universal Air Travel Plan or any other acceptable form of payment as advised by Qantas from time to time.

Documentation means any documentation made available or published on the Qantas Agency Connect Site.

Intellectual Property Rights means all intellectual property rights in Australia and throughout the world, including:

     (a)        patents, copyright, rights in circuit layouts, registered designs, trade or service marks, trade, business or company names, indication of source or appellation of origin, and any right to have confidential information kept confidential;

     (b)        any application or right to apply for registration of, or assert or waive, any of the rights referred to in paragraph (a); and

     (c)        moral rights, trade secrets, ideas, concepts, materials, know-how and techniques.

Licence has the meaning given to it in clause 3.1.

Qantas means Qantas Airways Limited (ABN 16 009 661 901).

Qantas Agency Connect Site means the Qantas Agency Connect Site at https://www.qantas.com/agencyconnect/au/en.html.

Qantas Booking Facility means the booking system on the Qantas Agency Connect Site.

Qantas Standard Agency Terms’ mean the Qantas Standard Agency Terms and Conditions, the latest version of which may be viewed at https://www.qantas.com/content/dam/qac/terms-and-conditions/qantas-standard-agency-terms-and-conditions.pdf.  

Registered User means the travel agent entity whose application for registration to access the Qantas Agency Connect Site has been accepted by Qantas.

Staff means officers, employees, contractors, subcontractors and agents.

You means a user of the Qantas Agent Connect Site and includes any Registered User.
